We understand that “terms of service” can be something scary to see. It could also make you think that there may be something hidden in all that lawyer speak. This “ToS” should be straightforward; however, if you have any questions regarding the below, please reach out to us directly BEFORE playing on our Servers.

At the end of the day, we run a Gaming Community and Host Servers. Our main goal is to provide a safe and friendly environment for everyone to enjoy.

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the Stone Industries Discord or playing on any of Stone Industries' Game Servers (the “Service”) operated by Stone Industries Gaming (“us” or “we”). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service and the Ways of Communication.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service or the various Ways of Communication.

AT WILL SERVICE

The Service provided to you is done so freely and at the expense of the Service. As such, we reserve the right to limit, restrict, or completely remove any individual(s) for any reason, without warning, notification, or an appeal process. An individual's time spent using the service should be done so freely and with the understanding that one’s time or in-game progress with the Service will never be compensated in any way, shape, or form, and any Virtual Goods purchased will not be refunded upon removal of the Service.

RULES OF CONDUCT & USAGE

The Service provides (“Ways of Communication”) through various means such as, but not limited to, Discord channels and in-game chat, designed to enable you to communicate with other Service users. Stone Industries Gaming has no obligation to monitor these Ways of Communication. Stone Industries Gaming reserves the right to limit, suspend, or even terminate your access to these Ways of Communication at any time, without warning and without reason.

You acknowledge that any user content (including, without limitation, chats, postings, or materials posted by users) on the Ways of Communication is neither endorsed nor controlled by us. Stone Industries Gaming will not, under any circumstances, be liable for any activity within the Ways of Communication. Stone Industries Gaming is not responsible for information that you choose to share on the Ways of Communication or for the actions of other users. As an example, you agree not to use the Service in order to:

• defame, libel, ridicule, mock, stalk, threaten, harass, intimidate or abuse anyone;
• engage in conduct that is fraudulent or illegal or otherwise harmful to Stone Industries or any other user;

TIME SPENT ON STONE INDUSTRIES

Stone Industries Gaming does not intend to harm individuals' progress, however, discontinuation of or from our services is a possibility for any individual at any time without notice, warning or cause. Each individual is responsible for their time spent using the Service and Ways of Communication and is under no obligation to us. You, as an individual, are investing your time freely and are not entitled to compensation for it from us in any way.

Time or Virtual Goods purchased while using the Service, no matter how much or long, does not entitle you to any proportional or disproportional say in how the Service is run, nor does not provide you with a stake in the Service and does not allow you to dictate future developments or absolve risk of being removed from the Service.

GAME PROGRESSION

Stone Industries Gaming is largely a curator of work provided by others (Modders & Developers). While the Service does its best to make all systems run smoothly together, there are times when issues occur. Due to coding, updates, or incompatibility outside of our control, crashes happen, progress may be lost, or deleted. While we can restore progression to some extent, that ability is a privilege. Due to our limited resources and time, we reserve the right to not replace or restore lost progression due to any issues while playing on the Service.

USER DISPUTES

While we promote a non-toxic environment, each individual is solely responsible for their interactions with other users of the Service and other parties that they come in contact with through the Service and various Ways of Communication. Stone Industries Gaming is not responsible or liable for the actions or discussions an individual may have with a Staff Member or Moderator when done so outside the Service, this Discord, or in private. We hereby disclaim any and all liability to you or any third party relating to your use of the Service.

TERMINATION

You may remove your Account at any time and for any reason by leaving the Discord group or deleting your Account from the Service. Stone Industries Gaming may remove your access to the Service at any time and for any reason. We also reserve the right to do so without a refund to you for any Virtual Good purchases to the Service.

INTELLECTUAL PROPERTY

Stone Industries Gaming reserves the right to use any material posted on our Discord, other various Ways of Communication, or on any of our Servers. This includes, but is not limited to, posts, images, videos, ideas, suggestions, or any content found on our Servers. An individual will not receive any compensation, royalties, or stake in the Service. Similar to Discord's ToS.

VIRTUAL GOODS, AND TERMS OF SALE

The Service includes an opportunity to obtain virtual goods (“Virtual Goods”) that may require payment using legal tender (that is, “real money”) to obtain the Virtual Goods. Your purchase of Virtual Goods is final and is not refundable, exchangeable, or transferable, except in the Services or the platform provider’s sole discretion or by regional law. We retain the right to modify, manage, control and/or eliminate Virtual Goods at our sole discretion. Prices and availability of Virtual Goods are subject to change without notice

REFUNDS OF VIRTUAL GOODS & MEMBERSHIPS

We will review all requests for a refund on a case-by-case basis and per regional laws. We are also not responsible for refunding or providing compensation to those who forget to cancel recurring subscriptions, similar to how other online subscriptions work.

DONATIONS/PURCHASES (FINANCIAL OR EQUIPMENT)

Any donations or assistance provided should be done so freely with no strings attached. Outside of any “thank you perks” already offered through our support platforms, no other compensation or special considerations will be provided. This doesn't make a donor a stakeholder in the Service or provide any special treatment when breaking a written rule. Donors are subject to the same “At Will” policy as all other users of the Service. This also applies to any supporters or individuals that purchase any Virtual Goods on any of the Services' various platforms.

USE OF IN-GAME VIRTUAL GOODS

Virtual Goods such as tech and other in-game resources, can change in value and worth over time. Nothing is guaranteed, permanent, or forever. Any in-game purchased Virtual Goods received should be used and enjoyed by the individual immediately. The Service is not responsible for refunding lost, stolen, deleted, removed, or unused Virtual Goods.

ANNUAL SUBSCRIPTIONS

Annual subscriptions are paid in full upfront and as such we give all the in-game Virtual Goods upfront, all at once, for maximum enjoyment.

Stone Industries Gaming can't guarantee what may happen within the span of a year. Stone Industries Gaming will continue our Virtual Goods in full and upfront. However, it can not claim that there will be a full year of enjoyment with the Virtual Goods.

This also holds true for any other subscription time periods

DATA COLLECT FROM MODS/PLUGINS

Stone Industries Gaming does not condone or support data collection from its Members, especially without permission. However, Stone Industries Gaming is not responsible for the actions of any 3rd Party Mod or Plugins used in association with any of its services or by its Members and is not responsible if any data is collected without permission from the End User.

THIRD PARTY TERMS & AGREEMENTS

While Stone Industries Gaming's above Terms of Service (“ToS”) is comprehensive, our Service works in conjunction with ToS of Third Parties such as but not limited to Discord and Keen Software House. Please seek out and read those ToS agreements. If you do not agree to any part of those ToS, you may not use or access the Service.

Stone Industries Gaming, in its sole discretion, may change this ToS at any time. Users will be notified of such a change via an announcement on this discord channel. These Terms of Service are enforceable by Stone Industries Gaming at their discretion, and violation of these terms will result in removal from the service.
